1. General Provisions
1.1. This document is a Public Offer Agreement (hereinafter "Agreement") and represents a formal offer by the Owner to any capable natural person or legal entity (hereinafter "User") to enter into a service agreement for the use of BearMND Expert Advisor under the conditions stated below.
1.2. Acceptance of this Offer constitutes full and unconditional agreement with all terms, as well as confirmation of the User's understanding of the risks associated with trading on financial markets.
1.3. The Offer is considered accepted and the Agreement concluded upon:

full payment for a license or product access including educational platform;
or submission of personal data for license activation.

1.4. The current version of this Agreement is always available at: @BearMND_Bot.

2. Description of Services
2.1. BearMND is a proprietary Expert Advisor (EA) developed for MetaTrader 5 (MT5), designed to execute trades automatically using technical logic and market patterns.
2.2. The service includes:

Provision of a personal license, bound to one MT5 account.
Technical instructions for setup and use.
Access to future software updates at no additional cost.
Access to educational platform.

2.3. Additional educational content may be provided at the Owner’s discretion.

3. Terms of Use
3.1. The User agrees:

To provide accurate personal data (Full Name, Email, Phone Number, Telegram handle, MT5 Account ID).
To use BearMND only for personal purposes, on the account it was licensed for.
Not to copy, distribute, sell, or reverse-engineer the EA.
Not to disclose training materials or license activation files.

3.2. The license is non-transferable and cannot be shared or resold.
3.3. All services are provided remotely through digital communication and file delivery.

4. Risks and Responsibility
4.1. BearMND does not provide investment advice, portfolio management, or guaranteed profits. The User understands and accepts:

The high risks of trading financial markets.
Full personal responsibility for all trading decisions.

4.2. The Owner is not liable for:

Any financial loss resulting from use of the EA;
Technical failures outside the Owner’s control (e.g. MetaTrader, broker errors, Internet disruptions).

4.3. The product is delivered "as is". The Owner makes no warranties as to uninterrupted operation or profitability.

5. Payment and Refund
5.1. All payments are made in advance and are non-refundable once the license is issued.
5.2. Payment options include bank transfers, crypto, PayPal, Revolut, or other methods as listed on the project’s official channels.
5.3. In case of license issues due to incorrect account ID or errors during installation, the Owner may, at their discretion, re-issue or adjust the license.

6. Intellectual Property
6.1. All software, training materials, texts, visuals, and communication templates are intellectual property of the Owner.
6.2. Reproduction, redistribution, or public disclosure of any of these assets without written permission is strictly prohibited and may lead to legal consequences.

7. Confidentiality
7.1. All data collected is processed in accordance with the Privacy Policy.
7.2. The Owner will not share or sell User data and commits to using it solely for licensing, support, and communication purposes.

8. Termination
8.1. The Owner reserves the right to terminate a User’s license without refund if they violate any part of this Agreement, what includes access to any platforms of the BearMND project.

9. Applicable Law
9.1. This Agreement is governed by the law of the Republic of Belarus as a country of citizenship of the owner.
9.2. Disputes will be resolved through negotiation or, if necessary, by the relevant jurisdiction based on the citizenship of the owner.
